{"id":959,"date":"2025-09-19T11:44:00","date_gmt":"2025-09-19T09:44:00","guid":{"rendered":"https:\/\/icorporate.it\/?post_type=cp_up_to_date&#038;p=959"},"modified":"2025-07-15T15:25:29","modified_gmt":"2025-07-15T13:25:29","slug":"the-new-eu-regulations-against-greenwashing","status":"publish","type":"cp_up_to_date","link":"https:\/\/icorporate.it\/en\/up-to-date\/the-new-eu-regulations-against-greenwashing\/","title":{"rendered":"The new EU regulations against greenwashing"},"content":{"rendered":"\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-1 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<p class=\"has-medium-font-size\">The European Union is introducing stricter regulations to counteract <strong>greenwashing<\/strong> and ensure transparent communication on environmental and social issues through advertising campaigns, social media, websites, press releases, promotional materials, product labelling and sustainability reports, both in <strong>textual and visual content.<\/strong><\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\"><\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\"><\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\"><\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p>The fight against <strong>greenwashing<\/strong> is in the interest of consumers but also of companies that, even if virtuous, may be negatively impacted by the general decline in mistrust towards them. According to the European Commission, in fact, <strong>40%<\/strong> of companies\u2019 environmental claims are not scientifically proven and <strong>53%<\/strong> provide vague, misleading or unfounded information.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>The main European regulatory initiatives in this context are:<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<ol>\n<li style=\"font-size:19px;font-style:normal;font-weight:400\"><strong>Directive 2024\/825\/EU &#8211; Empowering Consumers for the Green Transition, <\/strong>in forcesince the<strong> 26<sup>th<\/sup> of March 2024. <\/strong>Member States must transpose it by the 27<sup>th<\/sup> of March 2026 and apply it from the<strong> 27<sup>th<\/sup> of September 2026<\/strong>.<br><\/li>\n\n\n\n<li style=\"font-size:19px;font-style:normal;font-weight:400\"><strong>Proposal for a Green Claims Directive <\/strong>(Substantiation and communication of explicit environmental claims), presented by the European Commission in March 2023 and approved at first reading by the European Parliament on the 12<sup>th<\/sup> of March 2024. The text is currently awaiting final approval by the EU Council. Again, once it enters into force, Member States will have two years to implement it at national level.<\/li>\n<\/ol>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>These directives are part of the European policies for <strong>climate neutrality<\/strong> and <strong>ecological transition<\/strong>, in line with the <strong>European Green Deal<\/strong>.<\/p>\n<\/div>\n<\/div>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-2 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<p class=\"has-medium-font-size\"><strong><strong>The Empowering Consumers Directive<\/strong><\/strong><\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\"><\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\"><\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\"><\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p>The <strong>Empowering Consumers Directive<\/strong> amends Directives <strong>2005\/29\/EC<\/strong> (Unfair Commercial Practices) and <strong>2011\/83\/EU<\/strong> (Consumer Rights), introducing stricter measures to combat greenwashing and promote more informed consumer choices. The main changes include the <strong>ban on the use of generic and misleading environmental claims <\/strong>and non-certified<strong> sustainability labels<\/strong>.<\/p>\n\n\n\n<p><br>An \u201c<strong>environmental claim<\/strong>\u201d (\u201cgreen claim\u201d) is any marketing communication (including logos, symbols and images) that suggests or evokes a positive or reduced environmental impact of a product or service.<\/p>\n\n\n\n<p>This means, for example, that it will no longer be possible to use environmental claims such as \u201c<strong>environmentally friendly<\/strong>\u201d, \u201c<strong>eco<\/strong>\u201d, \u201c<strong>green<\/strong>\u201d, \u201cenergy efficient\u201d, \u201cbiodegradable\u201d, unless they are substantiated and supported by <strong>scientific, concrete and verifiable evidence<\/strong>.<\/p>\n\n\n\n<p>For climate claims such as \u201c<em>Net 0<\/em>\u201d, \u201c<em>carbon neutral<\/em>\u201d or \u201c<em>zero climate impact<\/em>\u201d, there is a further restriction: <strong>they may not be based solely on offsetting CO\u2082 emissions outside the value chain of the product or service<\/strong>. Claims will have to reflect <strong>the actual lifecycle impact of the product<\/strong>, without confusing direct emission reduction with carbon offsetting.<\/p>\n<\/div>\n<\/div>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-3 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<p class=\"has-medium-font-size\"><strong><strong>The Green Claims Directive<\/strong><\/strong><\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\"><\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\"><\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\"><\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p>The <strong>Green Claims Directive, still in the approval process<\/strong>, complements the Empowering Consumers Directive and applies to <strong>explicit green claims<\/strong>, i.e. explicit environmental self-declarations such as \u201c<em>T-shirt made from recycled plastic bottles<\/em>\u201d, \u201c<em>delivery with CO\u2082 offset<\/em>\u201d, \u201c<em>30% recycled plastic packaging<\/em>\u201d, \u201c<em>ocean-friendly sunscreen<\/em>\u201d.<\/p>\n\n\n\n<p>This directive will set standards for the <strong>verification, certification and reporting<\/strong> of such self-declarations. Specifically:<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<ul>\n<li style=\"font-size:19px;font-style:normal;font-weight:400\"><strong>Obligation of independent verification:<\/strong> every environmental statement must be supported by validated and third-party certified scientific data before its dissemination.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul>\n<li style=\"font-size:19px;font-style:normal;font-weight:400\"><strong>Greater transparency: <\/strong>information supporting green claims should be accessible to consumers, clearly worded and not misleading.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-4 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p>Once transposed, these directives will strengthen the Italian regulatory framework.<br>However, <strong>greenwashing<\/strong> already falls under <strong>misleading commercial practices<\/strong>, which are prosecuted by the <strong>Consumer Code<\/strong> and the <strong>Code of Advertising Self-Discipline<\/strong>.<\/p>\n<\/div>\n<\/div>\n","protected":false},"featured_media":929,"parent":0,"template":"","meta":{"_acf_changed":true},"ct_tipologia-up-to-date":[21],"acf":[],"_links":{"self":[{"href":"https:\/\/icorporate.it\/en\/wp-json\/wp\/v2\/cp_up_to_date\/959"}],"collection":[{"href":"https:\/\/icorporate.it\/en\/wp-json\/wp\/v2\/cp_up_to_date"}],"about":[{"href":"https:\/\/icorporate.it\/en\/wp-json\/wp\/v2\/types\/cp_up_to_date"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/icorporate.it\/en\/wp-json\/wp\/v2\/media\/929"}],"wp:attachment":[{"href":"https:\/\/icorporate.it\/en\/wp-json\/wp\/v2\/media?parent=959"}],"wp:term":[{"taxonomy":"ct_tipologia-up-to-date","embeddable":true,"href":"https:\/\/icorporate.it\/en\/wp-json\/wp\/v2\/ct_tipologia-up-to-date?post=959"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
